Participants will examine directors and officers liability including its basis in law, non-insurance protection available to non and for profit board members (including statutes, immunity laws, state-by-state), and a framework for analysis of insurance coverage. They will also understand the typical objections to coverage and data to counter these objections.
Participants will identify and examine current coverage issues, problems, and trends associated with key commercial inland marine coverages. They will discuss Builders Risk, Installation Floaters, Contractors Equipment, Jewelers Block and Warehouse Operators Legal Liability, and more.
Participants will examine the leading causes of error and omission claims against agents, owners, and agencies. They will discuss why and how to build an internal E&O Loss Control Program. They will discuss potential exposures, recognize how to minimize the exposures, and know what to do if a claim is made.
Agents will learn the professional, legal, and ethical responsibilities in dealing with the day-to-day realities of the complex, ethical issues of the insurance industry. They will be able to compare the difference between legal and ethical responsibilities and discuss the foundations of ethical behavior. They will review the core components of responsible agent conduct and better understand their duty to the customer, insurer, and peers. Agents will review the steps used in the ethical decision-making process and then apply them to real-life scenarios. They will discuss examples of improper conduct and how unethical behavior can create a breach in a legal requirement. They will also understand unfair business and claims practices model act provisions.
Using various case scenarios, adjusters will review the most current ISO Personal Auto Policy and endorsements to determine if the loss or situation is covered. They will discuss the claims and coverage scenarios, determine if the loss or situation is covered, and identify endorsements that may be needed to cover or expand coverage for the exposure. They will examine how the PAP provides or excludes coverage for exposures, such as: replacement vehicles, roommates driving covered autos, truck rental for personal use, hitting an animal, sunken car leaking oil in a lake, newly acquired autos, unlisted vehicles, vehicles used for livery and/or delivery, rental car, loading and unloading a vehicle, driving for Uber, death of a foster child, named insureds and divorce, and more. They will identify the problems and discuss possible solutions to better serve their clients.
In this session, participants will identify and discuss coverage gaps in the ISO Business Auto, Commercial General Liability, and Commercial Property policies, as well as the NCCI Workers Compensation and Employers Liability Policy. They will review the appropriate policy and endorsements and determine whether or not coverage is provided and how best to address any gaps in coverage.
