Anatomy of a Lawsuit: An Insurance and Risk Management Seminar
Participants will learn how court cases are disposed of in the United States from the insurance and risk management professional’s perspective. After an overview of the legal system as it relates to the insurance business, they will learn where to look to find basic information and how to identify legal issues that might arise. They will gain an understanding of how the declaratory judgment action and preliminary injunction intersect with insurance coverage and insurance business cases. They will conclude with a discussion to the trial and the alternatives to it.

Using recent personal lines and commercial lines insurance coverage cases, participants will sit as “jurors” in this interactive session. They will review and discuss the facts of each case and compare their decisions to the actual verdict by the appellate court. They will gain a better understanding of exposures and coverages provided in various insurance coverage forms, such as: Commercial General Liability, Homeowners, Personal Liability Umbrella, Business Auto, Workers Compensation, and Professional Liability.

They will discuss the benefits of Environmental Liability Insurance and review coverages provided in various EIL insurance policies including Green Insurance Coverage. They will examine how environmental liability insurance can fill gaps in standard property and casualty insurance to cover these unique exposures.
