OVERVIEW AND TOPICS


This course engages insurance professionals in collaborative breakout groups centered around real-world legal cases involving both personal and commercial lines. Each group will analyze case facts, review complaints, deposition excerpts, E&O issues, insurance policy language (if applicable) to form and present their group’s “expert opinion”. Through guided discussion and analysis of expert report excerpts, participants will explore critical topics such as agency authority, fiduciary duty, misrepresentation, risk analysis, product liability, structural collapse, professional liability, and wholesaler relationships. The session emphasizes understanding the nuances of coverage interpretation, recognizing the impact of documentation and communication, and identifying agent errors and omissions (E&O) exposures. By session end, Insurance Professionals will be better equipped to evaluate complex claim scenarios and apply best practices to mitigate disputes and uphold professional standards.
Participants will be able to differentiate between the types of Excess Liability Policies – Follow form excess, stand-alone excess, and commercial umbrella. They will compare policy provisions between policy forms from different companies. Agents will gain additional knowledge regarding what to look for when comparing company-specific Excess Liability Policy forms.
Do you know what to do when a crisis occurs? Uncover the insurance implications and general principles of crisis response for active assailants, product recalls, and data breach/cybersecurity incidents. Analyze a data breach claim and form a plan of action.
Using recent professional liability insurance coverage cases, participants will sit as “jurors” in this interactive session. They will review and discuss the facts of each case and compare their decisions to the actual verdict by the appellate court. They will gain a better understanding of exposures and insurance coverages pertinent to both traditional professionals and non-traditional classes of business.
