OVERVIEW AND TOPICS


In this session, participants take an in-depth look at the business income exposure. They review business continuation plans and learn the finer points of policy language and its effects on the insured. They will be able to explain the pros and cons of various endorsements, the use of the Extra Expense Coverage Form and the Leasehold Interest Coverage Form. Using a business income case study, participants will better understand catastrophe planning and be able to explain how Business Income Coverage, when properly designed, is critical to this process.
Using a case study format, participants identify and examine the issues and problems when providing property insurance protection for an insured whose insurable interest is created through a lease or other form of “contractual” arrangement. They will discuss Tenant Improvements and Betterments, Rental Income, Waivers of Subrogation, Additional Insureds, and sample provisions for lease language.
This session explores the variety of liability exposures and the insurance coverage designed to address these specific concerns. They will discuss the differences that exist between occurrence and claims-made triggers, the allocation of loss payments that span multiple policies, and how to remedy the coverage gaps that are presented by some of the GL exclusions.
Yin and Yang symbolize complementary forces that create balance, a concept mirrored in insurance policy wording. This session examines the interplay between coverage grants and exclusions in insurance policy wordings, showing how subtle changes in definitions and endorsements can create significant coverage implications. Participants will review real-world claims and court cases to see how courts interpret policy language across property, liability, crime, and specialty lines. Key topics include named insured rights, sister endorsements, coverage gaps, occurrence definitions, contractual liability, sole negligence disclaimers, liquor liability exclusions, and exhaustion methods in excess coverage. Emerging risks like crypto assets, NFTs (non-fungible tokens), and cyber exposures will also be explored. By session’s end, attendees will sharpen skills to identify pitfalls, assess policy language, and apply strategies to maintain balance—or recognize tension—within insurance contracts.
