OVERVIEW AND TOPICS

There are more than 140 different environmental insurance policies with no insurance industry standards on coverage designs to guide them. In this session, participants will learn how the coverage works in popular policy forms, how the underwriting works, and key pitfalls to avoid in the coverage. They will learn how to use environmental insurance to fill the coverage gaps created by pollution exclusions in property, general liability, auto, professional liability, and umbrella insurance policies. Using a case study in buying and selling a manufacturing plant with a known ground contamination problem, participants will discuss the practical uses of environmental insurance coverage.
In this session, agents will learn the differences between EPL policies and the practical effects of those differences on various exposures and classes of business; including the areas of exposure for independent contractors, leased employees, volunteers, and the various third-party coverages.
Participants will learn the professional, legal, and ethical responsibilities in dealing with the day-to-day realities of the complex, ethical issues of the insurance industry. They will compare the difference between legal and ethical responsibilities and discuss the foundations of ethical behavior. They will review the core components of responsible agent conduct and better understand their duty to the customer, insurer, and peers. Examples of improper conduct will be used to demonstrate possible unethical behavior and how this can create a breach in a legal requirement. They will also understand unfair business and claims practices model act provisions.
There are a multitude of cyber exposures beyond the information security-driven risks addressed by the typical cyber policy. In this session, participants will learn to identify those cyber exposures and examine their impact into property, casualty, and other claims that may arise. They will discuss the risk management challenges and discuss insurance coverage solutions found beyond the cyber policy for these unique exposures.
Participants will identify significant current commercial coverage issues and review the insurance coverage designed to address them. They will discuss coverage issues related to ordinance or law, valuation including agreed value versus agreed amount, major exposures when the insured has personal property of others in their care, and occurrence versus claims-made. They will learn about the problems and discuss possible insurance solutions to better serve their clients.
