OVERVIEW AND TOPICS


Using recent personal lines and commercial lines insurance coverage cases, participants will sit as “jurors” in this interactive session. They will review and discuss the facts of each case and compare their decisions to the actual verdict by the appellate court. They will gain a better understanding of exposures and coverages provided in various insurance coverage forms, such as: Commercial General Liability, Homeowners, Personal Liability Umbrella, Business Auto, Workers Compensation, and Professional Liability.
Participants will gain a better understanding of the fiduciary exposures facing their clients. They will learn about the duties of fiduciaries and discuss the potential exposures for fiduciaries. Using major, headline grabbing cases, they will discuss loss frequency and severity under ERISA for trustees, including a statistical analysis of the claims data and its impact on underwriting. The session concludes with an in-depth analysis of the typical fiduciary liability policy, specifically ISO’s Fiduciary Liability Coverage form.
Agents will examine the differences between the Personal Auto Policy (PAP) vs. the Business Auto Coverage Form (BAC/BAP), including “who is an insured,” eligibility, newly acquired autos, exclusions, and endorsements to provide the proper protection for the insured. For example, they will see that the PAP provides great coverage for the named insureds and their family member for “any” auto. The BAC is much more limited in nature and only provides coverage for the named insured for a “covered auto,” which leaves some auto users uninsured. They will analyze coverage differences between the two policies. They will review endorsements used to expand the insured definition under the PAP (Joint Ownership Coverage PP 03 34 and PP 13 03) and the BAC.
Hotels, restaurants, resorts, taverns, and other hospitality properties are susceptible to significant loss exposures. No industry was hit harder by COVID-19 than the hospitality industry. In this session, you will examine the property risks including real and intangible property, owned and leased space, business income, and extra expense. You discuss liability risks from guests, entertainers, general public, owners, franchisors, and employees. You will learn about the use of technology in the hospitality industry and the resulting exposures. You will identify the issues encountered when insuring hospitality risks, learn how to address these issues, and understand the coverage enhancements important to any hospitality type risk.
