OVERVIEW AND TOPICS


This course deepens understanding of coverage interpretation through real-world litigation examples. Participants will examine how court interpret language in Commercial Property, Business Auto, CGL, and Builders Risk policies. Topics include definitions of fixtures and permanently installed machinery, protective safeguards, and “complete working order” under commercial property policies. Business Auto discussions focus on Symbols 8 and 9. CGL discussions cover “property damage,” electronic data, “care, custody, or control,” in damage exclusions and impact of “separation of insureds” clauses on employer liability exclusions. Court rulings on assault and battery, human trafficking, and firearms exclusions are explored. Builders Risk coverage is explored through defect exclusions, LEG 3 language, and how court differentiates between defective work and resulting damage. In conclusion, participants gain skills to anticipate disputes and recognize how policy language is interpreted by court.
This course covers ISO’s 2025 revision to the Commercial General Liability (CGL) Policy. Insurance professionals will explore key updates to coverage forms, conditions, definitions, and endorsements—focusing on exclusions and clarifications related to data privacy, employment practices, electronic data, drones, EIFS, cannabis, AI, assault and battery, and punitive damages. The course includes analysis of case law and state statutes driving these changes, helping professionals interpret and apply the revised policy in practice. By course end, participants will be able to identify and explain the significance of new and revised endorsements, understand the rationale behind withdrawn exclusions and updated definitions, and apply insights from legal developments to coverage interpretation. This course equips professionals to navigate the evolving liability landscape with clarity and confidence.
In this session, participants will identify potential coverage pitfalls that could create problems and examine ways to solve them. They will review the appropriate Commercial Property policies and endorsements, such as the Building and Personal Property Coverage Form, as well as coverage for Landlords and Tenants, Ordinance or Law, Legal Liability Form, Leasehold Interest Coverage Form, and Protective Safeguards endorsements. They will discuss insurable interest in commercial property – who is the owner of the property, who is responsible for the property, and who will suffer financially if the property is damaged or destroyed. They will examine issues related to tenant’s improvements and betterments. They will identify various types of valuation and how each one works in a claim situation. They will look at how Ordinance or Law is addressed in a claim situation. They will learn the importance of Protective Safeguards endorsements – the purpose and how they work.
This course will unlock the hidden meanings behind the terms 'indemnification' and 'indemnitee.' The participants will have a clear understanding that indemnification and insurance are two separate things. They will gain a clearer understanding of how the CGL's insured contract really works and how it can and cannot be used to finance typical contractual risk transfer requests.
