OVERVIEW AND TOPICS

One of the most critical, yet complicated, exposures for any business is executive and professional risk. Participants will discuss the importance of analyzing and identifying their client’s specific needs in order to develop tailored solutions to protect their clients’ corporate and individual assets. They will learn how basic executive protection insurance coverage may be extended and used to benefit their clients. They will examine and gain an understanding of new insurance policy language regarding D&O Liability, Employment Practices Liability, Fiduciary Liability, and Crime.
After a brief review of the evolution of Employment Practices Liability Insurance (EPLI), participants will examine EPL Insurance, learn about the joint employer exposure, and review the overall critical management liability insurance aspects. They will discuss the ways exclusions may be presented in the policy and identify difficult risks facing their clients. They will review policy coverages and be able to identify the advantages of one coverage form over another.
Participants will examine the systematic process of writing insurance to provide protection for commercial clients who enter into contracts or who add additional insured endorsements to their insurance policies. They will analyze significant coverage issues encountered when entering into contracts and examples of hold-harmless and indemnification agreements found in leases and construction contracts. They will also review commercial liability and commercial auto coverages along with numerous additional insured endorsements.
Participants will identify potential loss exposures that exist when insuring leased real and personal property and learn the basic and optional coverages available to treat these exposures. They will learn a systematic process to analyze contractual obligations in relation to standard insurance policy provisions and to identify potential gaps in coverage. They will review common provisions found in real, personal property leases, examine important loss exposure and coverage issues when insuring tenant improvements and betterments, and learn how to provide the protection their client needs. They will evaluate how the Commercial General Liability (CGL) Policy compliments and conflicts with Business Auto Policy and Personal Auto Policy coverage provided for leased and rented mobile equipment and/or autos.
