Hot Spots in the Industry: Preventing E&O Losses
This course reviews key issues affecting insurance producers such as market conditions, parametric insurance products, regulatory developments, and workforce challenges facing the industry. Participants will examine additional insured requirements, certificates of insurance, and the 2026 ACORD 25 changes, along with related E&O exposures. The course also explores Employment Practices Liability Insurance (EPLI), covering employment law trends, EEOC activity, policy provisions, exclusions, and settlement considerations. Additional discussion addresses cyber and security breach insurance and how these coverages differ from traditional CGL and BOP policies. The course concludes with an examination of artificial intelligence in insurance, including its use in underwriting, claims handling, and fraud detection, while addressing important legal, ethical, regulatory, transparency, risk management, and data protection considerations for responsible implementation.
Issues in Named Insureds: The Rules and the Whys
This course examines the important issue of naming insureds correctly on insurance policies and the coverage implications that result from these decisions. Participants learn the rules for determining who should be listed as a named insured and the whys of these rules. The course reviews common business entities, including corporations, partnerships, and limited liability companies, and explores how their legal structures affect liability and insurance coverage. It also examines insurance policy provisions applicable to various entities, with particular emphasis on separation of insureds and its impact on coverage analysis. Case examples illustrate key concepts and common pitfalls. The course concludes with review of personal lines issues, including who qualifies as an insured under HO-3 and HO-4 policies, residency requirements, and naming trustees or personal representatives on policy, and insureds under Personal Auto Policies.
You Be The Jury
This interactive, fast-paced three-hour course places participants in the role of jurors as they evaluate real-world personal lines and commercial insurance coverage and liability disputes. Each case is based on an appellate court decision issued within the past several years. Participants review the facts, deliberate on the issues, and reach their own verdicts before comparing their conclusions to the actual court rulings. The seminar then examines the court’s reasoning, the final outcome, and the key coverage, liability, and claims lessons that can be applied in everyday insurance practice. Through active participation and discussion, attendees gain a practical understanding of how courts interpret policy language and resolve complex insurance disputes.
