Anatomy of a Construction Injury Claim
Participants will track through the claims and coverage questions arising in a serious construction injury case from beginning to end. The topics address the property and casualty insurance coverages that can be impacted. It will include an injured employee’s lawsuit and its relationship to worker’s compensation, liabilities for the condition of a construction site, and if there is insurance coverage for the construction site condition. The subject will close with how to address defective construction claims and indemnity claims in general.
Ethical Issues
In this session, participants will understand ethical challenges that insurance professionals face, difference between legal and ethical responsibilities and their fiduciary duties and obligations to the customer, insurer, and peers.
Steering The Business Auto Coverage Form
After an overview of the structure of the Business Auto Policy, agents will take an in-depth look at the coverages provided by the Business Auto Coverage Form (CA 00 01). They will review the important contract provisions including covered autos (symbols), liability, physical damage, conditions, Medical Payments, and Uninsured/Underinsured Motorists. They will identify important BAP exclusions and their impact on the insured. They will examine specific BAP endorsements and discuss how they can amend policy provisions, add coverage, or restrict coverage.
Contractual Risk Transfer
Participants will examine contractual risk transfer as an insurance and non-insurance technique. They will examine various categories of indemnity agreements, such as Hold Harmless and Exculpatory agreements. They will identify potential problems and explore alternate ways to minimize insurance coverage conflicts.
